Acceptance of the Terms of Use

These Terms of Service ("Terms") are entered into by and between you and Elisa Blake ("the App", "we", "us"). By downloading, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

Age Requirements

You must be at least 17 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

Nature of the Service

Elisa Blake is an entertainment app featuring "Elisa," a fictional AI character powered by a third-party artificial intelligence service (OpenAI). Elisa is not a real person, does not have consciousness or feelings, and any warmth, personality, or emotional responsiveness she displays is simulated for entertainment purposes only. The App is not a substitute for professional advice, therapy, counseling, or a real human relationship. If you are experiencing a mental health crisis, please contact a licensed professional or your local emergency services.

Use of Services

You agree to use the App only for lawful purposes and in compliance with all applicable laws and regulations. You agree not to:

• Use the App to generate, request, or attempt to extract sexually explicit, exploitative, hateful, violent, or illegal content.
• Attempt to reverse-engineer, extract, or misuse the underlying AI models or system prompts.
• Use the App to harass, harm, or impersonate any person.
• Use automated means (bots, scrapers) to access the App.
• Interfere with or disrupt the functioning of the App or the servers/networks connected to it.

We reserve the right to filter, moderate, or refuse to generate content that violates these Terms, and to suspend or terminate accounts that repeatedly attempt to violate them.

Subscriptions & In-App Purchases

The App offers auto-renewing subscriptions and consumable credit packs, billed through your Apple App Store account via RevenueCat. By purchasing a subscription, you authorize recurring charges at the price and interval shown at the time of purchase until you cancel. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your device's App Store account settings. Consumable credit packs are non-refundable once used, except as required by applicable law or Apple's refund policies.

Third-Party AI Service

Your conversations with Elisa are processed by OpenAI, a third-party AI service provider, in order to generate responses. See our Privacy Policy for full details on what data is shared and how it is used.

User Content

You retain ownership of the messages you send. By sending a message, you grant us a limited license to process, store, and transmit that content (including to OpenAI) solely to operate and improve the App. You are responsible for ensuring your use of the App complies with these Terms.

Intellectual Property

All intellectual property rights related to the App, including but not limited to software, the Elisa character, artwork, and trademarks, are owned by or licensed to us. You may not copy, modify, distribute, or reproduce any part of the App without our prior written consent.

Disclaimer & Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, express or implied. AI-generated responses may occasionally be inaccurate, out of character, or inappropriate despite our safety filters; we do not guarantee the accuracy or appropriateness of any Output. To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the App.

Termination

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, for any reason, including violation of these Terms. You may stop using the App and delete your account at any time from the Profile screen.

Modifications of Terms

We reserve the right to change these Terms from time to time. Changes are effective immediately upon posting. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
